2. Scope and Conclusion of the Agreement
2.1. These General Terms and Conditions (Terms) govern the use of the MOTEVE platform at moteve.hu and app.moteve.hu and the guest-side services available there.
2.2. MOTEVE is a digital booking and motivation platform for boutique sports, movement and wellness studios (Studios).
2.3. MOTEVE provides technical infrastructure for user accounts, Studio and Class listings, bookings, waiting lists, purchase and management of passes, payment and invoicing integrations, notifications and activity and motivation features.
2.4. Use of the guest platform is free of charge for Users. MOTEVE charges Users no fee for using the platform. Prices of Classes, passes and other Studio services are set by, and payable to, the relevant Studio.
2.5. The agreement between the User and MOTEVE is concluded when the User completes registration and accepts these Terms electronically. It is an electronic contract, not a written contract; MOTEVE does not file it, but the system records the accepted version of the Terms and the time of acceptance. The contract language is Hungarian (or English, at the User’s choice).
2.6. Users may correct input errors on the relevant form before finalising registration, a booking or a purchase; the system summarises the data entered before finalisation.
2.7. MOTEVE has not subscribed to any code of conduct.
3. Roles of MOTEVE and the Studio
3.1. Classes, sessions, services and passes on the platform are offered by the relevant Studio. Studios are traders; in respect of the contract with the Studio, the User has the rights granted by consumer protection law.
3.2. When a User books or purchases a Studio service, the contract for that service is concluded directly between the User and the Studio.
3.3. MOTEVE does not become the provider or seller of the Studio service, is not the beneficiary of the fee and is not responsible for the professional content or quality of the Studio service. MOTEVE is responsible for the operation of the platform; the Studio is responsible for performing its own service.
3.4. Each Studio sets its own cancellation, no-show, refund, pass-use, attendance and house rules, which the User can review on the Studio’s page before booking or purchase.
4. Order in Which Studios Are Displayed
4.1. Studios matching the search criteria (location, class type, Studio name) are displayed by default in descending order of their number of active members.
4.2. An active member is a User who attended at least one Class of the Studio in the last 30 days, with attendance recorded in the system.
4.3. The display order is not influenced by any fee or other remuneration paid by Studios to MOTEVE.
5. Registration and User Account
5.1. Registration is required to book and purchase. Users may register with an e-mail address and password or with a Google, Apple or Facebook account.
5.2. Users must provide at least their first name, last name and e-mail address, accurately and up to date. Providing a telephone number is optional.
5.3. Users must confirm their e-mail address before their first booking.
5.4. Two-factor authentication applies to accounts created with an e-mail address and password. Users must keep their credentials and authentication devices secure.
5.5. Accounts may not be transferred or created on behalf of another person without authorisation.
6. Users Aged 16–17
6.1. Persons under 16 may not create a MOTEVE account.
6.2. Users aged 16 or 17 provide their date of birth and the name and e-mail address of their legal representative during registration. MOTEVE sends the legal representative a single-use electronic approval request.
6.3. By approving, the legal representative declares that they are the minor’s legal representative, consents to the minor’s use of MOTEVE and of paid Studio services through it, and has read these Terms and the Privacy Notice.
6.4. Until approval, the account is restricted: paid services and passes cannot be purchased and bookings involving payment cannot be finalised. The age check also applies to registration via social login.
7. Profile and Profile Picture
7.1. Users may add further information to their profile; uploading a profile picture is optional.
7.2. The profile picture is visible to the User, to authorised administrators of a Studio whose service the User has booked and to the instructor of the booked Class.
7.3. Profile pictures must not be unlawful, offensive, misleading or infringing; MOTEVE may remove such pictures.
8. Bookings
8.1. Users may book a Class where places are available. Finalisation is subject to the payment method and other conditions set by the Studio.
8.2. Where a booking involves a payment obligation, the finalising button clearly indicates this.
8.3. For online payments, the selected place is held for up to 5 minutes. If payment is not completed successfully within that time, the place is released. After successful payment the booking is confirmed automatically.
9. Waiting List
9.1. For full Classes, the Studio may operate a waiting list. When a place becomes available, Users on the list are notified by e-mail in the order in which they joined.
9.2. A notification is not an automatic booking; the User may book the place in the system while it remains available.
10. Payment Methods
10.1. The Studio decides which payment methods it offers: online card payment (Barion, Stripe or SimplePay), bank transfer, on-site card or cash payment, or use of an existing pass. One online payment provider is active per Studio at a time.
10.2. For online payments the User uses the payment provider’s system; card data are processed by the payment provider and are not stored by MOTEVE.
10.3. Amounts paid by the User belong to the relevant Studio and are received into the Studio’s own payment-provider account.
10.4. For bank transfer, a booking may be created before the amount arrives, with “Awaiting payment” status. The Studio verifies receipt; the consequences of late or missing payment are set by the Studio’s terms.
11. Passes
11.1. Studios may offer passes that Users can purchase on the platform. The price, number of sessions, validity period and conditions of use are set by the Studio and shown before purchase.
11.2. Unless the Studio provides otherwise, validity starts on the purchase date.
11.3. When booking with a pass, the session is deducted automatically; restoration after cancellation follows the Studio’s cancellation rules.
12. Invoicing
12.1. Invoices are always issued by the relevant Studio in its own name, typically through Számlázz.hu or Billingo. MOTEVE does not become the issuer.
12.2. Users must provide the data needed for invoicing; company invoices require company name, billing address and tax number.
13. Cancellation, No-show and Classes Cancelled by the Studio
13.1. Cancellations are governed by the Studio’s own rules, including the free-cancellation deadline, restoration of pass sessions and refunds.
13.2. The Studio may mark a User as a no-show if the User does not attend without prior cancellation. The financial and pass-related consequences are set by the Studio’s previously published rules.
13.3. The Studio may cancel or change a Class where justified; the system sends a notification. For a cancelled Class the deducted pass session is restored; for online payments the Studio initiates the refund.
14. Refunds
14.1. Refund entitlement is determined by law and the Studio’s terms; refunds are initiated by the Studio.
14.2. Crediting time depends on the payment provider and the User’s financial institution.
15. Consumer Right of Withdrawal
15.1. For distance contracts, consumers generally have a 14-day right of withdrawal or termination.
15.2. Under Section 29(1)(l) of Government Decree 45/2014 (II. 26.), the right of withdrawal does not apply to leisure services where the contract specifies a date or period of performance. This covers Classes booked for a specific time.
15.3. For passes and non-time-specific services, applicability of the right of withdrawal depends on the nature of the service and the law; withdrawal statements must be addressed to the Studio.
15.4. Nothing in these Terms excludes any statutory consumer right.
16. Health and Participation
16.1. Users must inform the instructor of any injury, health limitation, pregnancy or other circumstance that may affect safe participation. If in doubt, Users should consult a healthcare professional before participating.
16.2. Health data need not and should not be recorded in MOTEVE; Users should discuss such matters directly with the instructor.
16.3. MOTEVE is not a healthcare provider; information on the platform is not medical advice.
17. Notifications and Marketing
17.1. MOTEVE sends service notifications by e-mail and, where the User enables them, as push notifications, about registration, security events, bookings, payments, Class changes, cancellations, waiting lists and upcoming bookings. These are not marketing messages.
17.2. MOTEVE and individual Studios may send marketing messages only with the User’s separate prior consent. Consent for MOTEVE and for Studio marketing is separate, is never a condition of using the service and can be withdrawn at any time in the profile or via the unsubscribe link in each message.
18. Cookies
18.1. The platform uses cookies necessary for its operation, and analytics cookies only with the User’s consent. Consent is given in the cookie banner and can be changed later. See the Cookie Notice for details.
19. User Conduct
19.1. Users must not access another account without authorisation, provide false data, circumvent security measures, disrupt the platform, launch automated attacks or malicious code, or infringe the rights of others.
20. Availability and Third-Party Services
20.1. MOTEVE aims for continuous and secure operation but does not guarantee uninterrupted availability. Maintenance, updates, third-party failures, infrastructure issues, force majeure or security incidents may cause temporary restrictions.
20.2. Third-party services (authentication, payment, invoicing, e-mail, push notifications) are connected to the platform and are subject to their own terms.
21. Liability
21.1. MOTEVE is liable for the proper operation of the platform service in accordance with the law.
21.2. The Studio is responsible in particular for delivering the Class, the instructor’s professional suitability, service quality, the venue, pricing, cancellation rules, refunds and invoice content.
21.3. This section does not limit any liability of MOTEVE that cannot be excluded or limited by law.
22. Suspension and Deletion of the Account
22.1. MOTEVE may temporarily restrict or suspend an account where there are reasonable grounds to suspect misuse, breach of these Terms, compromised account security or unlawful activity. Unless security reasons prevent it, MOTEVE informs the User with reasons.
22.2. Users may delete their account in the system at any time. Deletion does not affect data whose retention is required by law or another legal basis; see the Privacy Notice.
23. Complaints
23.1. Complaints about MOTEVE may be made in writing to [email protected] or by post to the registered office, or orally in person at the registered office.
23.2. MOTEVE examines oral complaints immediately where possible; otherwise it records them in minutes and sends a copy. MOTEVE answers written complaints in writing, on the merits, within 30 days of receipt; if a complaint is rejected, MOTEVE gives reasons and informs the User about authority and conciliation-body remedies.
23.3. Complaints about a specific Studio service (Class, pass, refund, invoice) must be submitted to the Studio; MOTEVE assists and forwards the complaint on request.
24. Conciliation Body and Other Remedies
24.1. In consumer disputes, the User may turn to a conciliation body. As a rule, the body competent for the User’s place of residence or stay proceeds; at the User’s request, the body competent for MOTEVE’s registered office:
Pest County Conciliation Body (Pest Vármegyei Békéltető Testület) Address 1055 Budapest, Balassi Bálint u. 25. IV/2. Telephone +36 1 792 7881 E-mail [email protected] Website panaszrendezes.hu 24.2. Contact details of all conciliation bodies are available at bekeltetes.hu. MOTEVE cooperates in conciliation proceedings.
24.3. Users may also file a consumer protection complaint with the county government office competent for their residence (consumer protection authority) or bring a claim before the courts.
25. Privacy and Intellectual Property
25.1. MOTEVE processes personal data in accordance with its Privacy Notice, available as a separate document.
25.2. The MOTEVE platform, its design, brand elements, texts and software are legally protected; unauthorised copying, commercial use or distribution is prohibited.
26. Amendments
26.1. MOTEVE may amend these Terms. MOTEVE notifies Users of material amendments by e-mail and on the platform at least 15 days before they take effect. Users who do not accept an amendment may delete their account free of charge before it takes effect.
26.2. Amendments may not restrict consumer rights already acquired and do not affect bookings already made.
27. Governing Law and Language
27.1. These Terms are governed by Hungarian law, in particular Act V of 2013 (Civil Code), Government Decree 45/2014 (II. 26.), Act CLV of 1997 on Consumer Protection and Act CVIII of 2001 on Electronic Commerce.
27.2. These Terms are available in Hungarian and English; in case of inconsistency the Hungarian version prevails unless mandatory law provides otherwise.
